Welcome to TextNest. These Terms and Conditions govern your access to and use of the TextNest mobile application, including all related features, tools, content, services, updates, and functionality made available through the app. By downloading, installing, accessing, or using TextNest, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the app.
1. About TextNest
TextNest is an Android messaging application designed to function as an alternative SMS application. The app may include standard SMS-related features, along with additional features such as message categorization, AI-suggested replies, message vault functionality, scheduled SMS sending, and informational content sections such as news, sports, updates, channels, or similar content areas. TextNest is intended to help users manage SMS communication more efficiently. The app does not replace your mobile carrier, mobile network provider, emergency communication services, or device operating system.
2. Acceptance of These Terms
By using TextNest, you confirm that:
You have read, understood, and agreed to these Terms.
You are legally permitted to use the app in your country or region.
You are responsible for all activity that occurs through your device and through your use of the app.
You will use TextNest only for lawful, personal, and permitted purposes.
If you are using TextNest on behalf of another person or organization, you confirm that you have the authority to accept these Terms on their behalf.
3. Eligibility
TextNest is intended for users who are legally allowed to use SMS messaging services and mobile applications in their country or region.
You should not use TextNest if you are under the minimum legal age required to use such services in your location, unless you have permission from a parent or
legal guardian. Parents or guardians are responsible for supervising the use of TextNest by minors.
4. Default SMS App and Permissions
Certain features of TextNest may require the app to be set as the default SMS application on your Android device. When TextNest is set as your default SMS app, it may request access to permissions required to send, receive, read, organize, display, store, and manage SMS or MMS messages. These permissions may include access to SMS messages, contacts, notifications, storage, device information, and other permissions
required for app functionality. Some features may not work properly if: TextNest is not selected as the default SMS app. You deny required permissions.
Your device settings restrict background activity, notifications, SMS access, or scheduled sending. Your mobile carrier blocks or delays messages. Your device does not support certain Android features. You may change your default SMS app at any time through your Android device settings. If TextNest is no longer your default SMS app, some messaging features may become unavailable or limited.
5. SMS and Messaging Functionality
TextNest may allow you to send, receive, read, organize, search, categorize, archive, delete, schedule, or manage SMS and related messages.
You are solely responsible for the content of all messages you send using TextNest.
TextNest does not guarantee that any SMS or message will be delivered, delivered on time, received, read, or displayed correctly. SMS delivery depends on factors outside the app’s control, including your carrier, recipient carrier, network availability, device settings, recipient number, country restrictions, roaming
status, and applicable telecom rules. Standard SMS, MMS, carrier, roaming, data, or other charges may apply based on your mobile plan. TextNest is not responsible for any charges imposed by your mobile carrier or network provider.
6. Scheduled SMS Sending
TextNest may include a scheduled SMS feature that allows you to prepare messages to be sent at a future date or time. You are responsible for reviewing and confirming all scheduled messages before they are sent. Scheduled SMS delivery may be affected by device settings, battery optimization, network availability, carrier limitations, app permissions, device restart, operating system restrictions, time zone settings, or other technical conditions.
TextNest does not guarantee that scheduled messages will be sent exactly at the selected time. You are responsible for cancelling, editing, or deleting scheduled messages if you no longer want them to be sent. You should not rely on scheduled SMS for emergencies, urgent matters, medical reminders, legal notices, financial instructions, security alerts, or any communication where failure or delay could cause harm, loss, or serious consequences.
7. AI-Suggested Replies and AI Features
TextNest may provide AI-generated or AI-suggested replies, message summaries, smart suggestions, categorization support, or similar AI-assisted features.
AI suggestions are provided for convenience only. They may be inaccurate, incomplete, inappropriate, outdated, or unsuitable for your specific situation.
You are fully responsible for reviewing, editing, approving, and sending any message created or suggested by AI features.TextNest does not represent that AI-generated suggestions are correct, professional, legally appropriate, emotionally appropriate, safe, or suitable for any particular communication. You should not rely on AI suggestions for legal, medical, financial, emergency, professional, or high-risk decisions. You agree not to use AI features to generate or send unlawful, abusive, harassing, fraudulent, misleading, hateful, threatening, sexually exploitative, defamatory, spam, or harmful content. TextNest may provide ways to report problematic AI outputs, unsafe suggestions, or inappropriate content. Reports may be reviewed to improve app safety and quality.
8. Message Categorization
TextNest may include automatic or manual categorization features that group messages into categories such as personal, transactions, promotions, spam,
reminders, OTPs, informational messages, or other categories. Categorization may not always be accurate. Important messages may be placed in the wrong category, and unwanted messages may not always be detected. You are responsible for reviewing all message categories and ensuring that you
do not miss important communication.TextNest is not responsible for any loss, delay, missed opportunity, missed payment, missed deadline, or other consequence caused by inaccurate message categorization.
9. Vault Feature
TextNest may include a vault or protected message area that allows you to hide, lock, secure, or separately store selected messages or content. You are responsible for maintaining the security of your device, lock screen, passwords, PINs, biometrics, vault credentials, recovery options, and related
access methods. TextNest may not be able to recover vault content if you lose access to your device, delete the app, clear app data, reset your phone, forget your password, or fail to maintain backup settings. The vault feature is intended to provide additional privacy within the app experience. It should not be treated as a substitute for professional-grade encryption, legal evidence storage, regulated records management, or secure
archival systems. You should maintain your own backups of any important messages or information.
10. Informational Content and Channels
TextNest may include informational sections or channels, such as news, sports, entertainment, updates, tips, alerts, or other content.
This content may be provided by TextNest, third-party providers, automated systems, feeds, publishers, APIs, or other sources. Informational content is provided for general information and convenience only. It may not always be accurate, complete, current, or available.
TextNest does not guarantee the accuracy, reliability, completeness, neutrality, timeliness, or usefulness of any informational content.
TextNest does not provide professional advice, investment advice, legal advice, medical advice, betting advice, political advice, or financial recommendations
through informational content sections.
Any action you take based on informational content is at your own risk.
11. User Content
“User Content” includes messages, scheduled messages, saved messages, vault content, contact-related information, categories, labels, preferences, feedback, reports, and any other content or information that you create, send, receive, store, or manage through TextNest.
You retain ownership of your User Content.
You grant TextNest the limited rights necessary to operate the app, provide app features, process messages locally or through supported services where
applicable, improve functionality, maintain security, troubleshoot issues, and comply with legal obligations.
TextNest does not claim ownership over the content of your SMS messages.
You are responsible for ensuring that your User Content does not violate any law, third-party right, privacy right, intellectual property right, or contractual
obligation.
12. Prohibited Uses
You agree not to use TextNest for any unlawful, harmful, abusive, or unauthorized purpose.
You must not use TextNest to:
Send spam, bulk unsolicited messages, or unauthorized promotional messages. Harass, threaten, abuse, impersonate, defraud, or mislead others.
Send phishing messages, scam messages, malware links, deceptive links, or fraudulent content.
Violate telecom laws, anti-spam laws, privacy laws, consumer protection laws, or other applicable rules.
Send messages that contain hate speech, threats, sexual exploitation, child abuse material, non-consensual intimate content, or content encouraging violence or self-harm.
Attempt to bypass Android security controls, carrier restrictions, app permissions, or Play Store policies.
Reverse engineer, copy, modify, resell, sublicense, or exploit the app except as permitted by law.
Use the app to interfere with another person’s device, network, privacy, or communications.
Misuse AI-suggested replies to create harmful, deceptive, illegal, or abusive content.
Use scheduled SMS features to automate spam, harassment, fraud, or unlawful campaigns.
TextNest may suspend, restrict, or terminate access to the app if misuse is detected or reasonably suspected.
13. Privacy
Your use of TextNest is also governed by the TextNest Privacy Policy.
The Privacy Policy explains how data may be collected, used, stored, shared, protected, and managed in connection with the app.
Please review the Privacy Policy carefully before using TextNest.

If there is any conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy will control for privacy-related matters.
14. Permissions and Device Access
TextNest may request device permissions needed to provide app functionality.
These may include permissions related to SMS, contacts, notifications, storage, internet access, device state, background activity, and other Android-supported features.
You can control permissions through your device settings. However, disabling certain permissions may affect app functionality.
TextNest will only be able to perform certain actions when the required permissions are granted and when Android allows those actions.
15. Third-Party Services
TextNest may rely on third-party services, APIs, libraries, SDKs, cloud services, analytics tools, crash reporting tools, content providers, AI service providers, advertising networks, payment processors, or other technology partners.
Third-party services may be subject to their own terms, privacy policies, limitations, and availability.
TextNest is not responsible for third-party services, third-party content, third- party outages, third-party data practices, or third-party errors.
Your use of third-party services may be governed by additional terms provided by those third parties.
16. App Updates and Changes
TextNest may be updated, modified, improved, restricted, suspended, or discontinued at any time.
Updates may add, remove, or change features, functionality, design, performance, permissions, compatibility, content, or technical requirements.
Some updates may be required for security, compliance, or continued functionality.
TextNest is not obligated to continue providing any specific feature permanently.
17. Availability and Compatibility
TextNest is designed for supported Android devices. Availability and performance may vary depending on device model, Android version, region, carrier, permissions, network status, storage space, battery settings, and other conditions.
TextNest does not guarantee uninterrupted, error-free, secure, or always- available service.
The app may be unavailable due to maintenance, updates, technical issues, third- party outages, policy changes, device limitations, or other reasons.
18. Backups and Data Loss
You are responsible for maintaining backups of important messages, contacts, vault content, scheduled messages, settings, and other data.
TextNest may not be able to restore deleted messages, lost vault content, failed backups, cleared app data, or data lost due to device damage, device reset, app uninstall, operating system changes, permission changes, storage issues, or user error. You should not rely on TextNest as the only storage location for important information.
19. Security
TextNest may use reasonable technical and organizational measures designed to protect app functionality and user data.
However, no mobile application, device, network, storage method, or transmission method is completely secure.
You are responsible for protecting your device, SIM card, lock screen, passwords, biometrics, app permissions, Google account, backups, and any other access points.
You should immediately stop using TextNest and secure your device if you believe your device or messages have been compromised.
20. Emergency Communications
TextNest is not designed or intended for emergency communications. You should not rely on TextNest for contacting emergency services, sending
urgent safety messages, medical alerts, legal notices, financial instructions, crisis messages, or other time-sensitive communications.
For emergencies, use your phone’s native emergency calling features or contact emergency services directly.
21. Intellectual Property
TextNest, including its name, logo, interface, features, design, software, source code, graphics, icons, text, layout, branding, and other app materials, is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, lease, reverse engineer, decompile, create derivative works from, or commercially exploit TextNest
without prior written permission, except where permitted by applicable law.
Using TextNest does not give you ownership of the app or any related intellectual property rights.
22. Feedback
You may choose to provide feedback, suggestions, bug reports, reviews, feature requests, or other comments about TextNest.
By submitting feedback, you allow TextNest to use, modify, implement, publish, or incorporate that feedback without obligation, restriction, or compensation to you.
You confirm that your feedback does not contain confidential information or third-party proprietary material unless you have permission to share it.
23. Paid Features, Subscriptions, or In-App Purchases
TextNest may offer free features, paid features, subscriptions, premium tools, or in-app purchases.
Any pricing, billing, renewal, cancellation, refund, or subscription terms will be shown in the app or through the applicable app store or payment provider.
If purchases are made through Google Play, billing and refunds may be handled according to Google Play’s applicable payment and refund rules.
TextNest may change pricing, features, trial periods, or paid plan availability at any time, subject to applicable law and platform rules.
If TextNest does not currently offer paid features, this section will apply only if such features are introduced in the future.
24. Advertising and Promotions
TextNest may display ads, sponsored content, promoted channels, offers, or other commercial content. Ads or promotions may be provided by third-party advertising partners.
TextNest does not endorse all products, services, claims, or offers displayed through advertisements or promoted content. You are responsible for evaluating any third-party offer before interacting with it.
25. Suspension or Termination
TextNest may suspend, restrict, or terminate your access to the app or certain features if :
You violate these Terms.
You misuse SMS, AI, vault, scheduling, or content features.
Your use creates legal, security, technical, privacy, or compliance risks.
Required permissions are removed.
The app is discontinued or no longer supported.
Required third-party services become unavailable.
Termination may result in loss of access to certain features or data. You are responsible for backing up important information before deleting the app or changing devices.
26. Disclaimers
TextNest is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, TextNest makes no warranties or representations of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, non-infringement, or uninterrupted operation.
TextNest does not guarantee that :
Messages will always be delivered.
Scheduled messages will always send at the exact selected time.
AI suggestions will be accurate or appropriate.
Message categorization will always be correct.
Vault content will always be recoverable.
Informational content will always be accurate or current.
The app will be free from errors, bugs, interruptions, or security issues.
The app will remain compatible with every Android device, carrier, or operating system version.
27. Limitation of Liability
To the maximum extent permitted by law, TextNest and its owners, developers, operators, service providers, partners, licensors, and affiliates will not be liable
for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages.
This includes damages or losses related to:
Failed, delayed, incorrect, or missed SMS delivery.
Scheduled messages sent late, not sent, or sent unintentionally.
AI-generated suggestions or user-edited messages.
Incorrect message categorization.
Lost, deleted, inaccessible, or exposed messages.
Vault access issues or lost vault content.
Missed reminders, missed deadlines, or missed communications.
Carrier charges, roaming charges, SMS charges, MMS charges, or data charges.
Third-party content, news, sports updates, channels, APIs, ads, or services.
Device issues, Android restrictions, carrier limitations, or permission changes.
Unauthorized access to your device or account.
Your total remedy, if any, will be limited to the amount you paid directly for TextNest during the period allowed by applicable law. If you used TextNest for
free, your remedy may be limited to discontinuing use of the app.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
28. Indemnity
You agree to defend, indemnify, and hold harmless TextNest and its owners, developers, operators, service providers, partners, licensors, and affiliates from
any claims, damages, losses, liabilities, costs, and expenses arising from:
Your use or misuse of TextNest.
Your violation of these Terms.
Your messages, scheduled messages, AI-assisted messages, or User Content.
Your violation of any law or third-party right.
Your use of TextNest for spam, harassment, fraud, unlawful communication, or unauthorized activity.
Your failure to secure your device, vault, permissions, or account.
29. Compliance With Laws
You are responsible for complying with all laws, rules, and regulations that apply to your use of TextNest.
This may include laws relating to SMS, telecommunications, privacy, data protection, anti-spam rules, marketing messages, consumer protection, intellectual property, electronic communications, and prohibited content.
You must not use TextNest in any way that is illegal in your country, region, or the recipient’s country or region.
30. App Store Terms
If you download TextNest from Google Play or another app marketplace, your use of the app may also be subject to that marketplace’s terms, policies, and rules.
If there is a conflict between these Terms and the app marketplace’s required terms, the marketplace’s terms may apply to the extent required for your use of that marketplace.
31. Changes to These Terms
TextNest may update these Terms from time to time. When changes are made, the updated Terms may be posted in the app, on the website, or through another reasonable method. The “Last Updated” date may also be revised. Your continued use of TextNest after changes become effective means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using TextNest.
32. Governing Law
